Redundancy arises where there is a genuine reduction in the need for employees to carry out work of a particular kind, rather than being about the performance of the individual. A fair process typically involves a clear rationale, a fair selection method, meaningful consultation, and consideration of suitable alternative roles.

Getting the process wrong, even where the underlying business case for redundancy is genuine, can expose an employer to unfair dismissal claims. Employers should also be aware of additional collective consultation obligations that can apply where a larger number of redundancies is proposed within a short period.
